California lawmakers quietly gutted budget bill AB144 on the last day of session and slipped in sweeping changes to vaccine and parental rights. Amy Bohn of PERK explains how the law signed by Governor Gavin Newsom bypassed the legislative process, hands vaccine decision-making power to the California Department of Public Health, revives HPV recommendations, expands liability protections, and sidelines future ACIP and CDC recommendations. This bill strips parents and the public of their voice and hands unchecked power to the unelected body of the California Department of Public Health. This is a dangerous law.

AB144:

Centralizes vaccine authority by giving the California Department of Public Health (CDPH) so much power related to immunizations, bypassing the legislature.
Expands liability protections beginning January 1, 2030, shielding anyone administering state-required vaccines to minors from ANY accountability or liability for injury or harm caused.
Adds language about the HPV vaccine with additional language to the mandated notification. The section on the HPV vaccine references Section 120164, a newly added Health Code Section that alarmingly gives CDPH the power to modify or supplementexisting recommendations.
Rejects CDC and ACIP standards, freezing recommendations as of January 1, 2025 and disregarding future updates.
Alters insurance and welfare laws without public input.
No longer has any checks, balances, or oversight for the health department, with modifications to the immunization recommendations effective immediately. The new law states the health department can modify immunization recommendations and “Any modification or supplement shall be deemed effective on the date of publication.”
The health department seems to have no one to report to and requires no public participation as, “The recommendations and schedules shall be filed with the Secretary of State and published in the California Code of Regulations.”
