URGENT ACTION ALERT UPDATE TO
STOP THE PESTICIDE LIABILITY SHIELD IN THE 2026 FARM BILL
The 2026 Federal Farm Bill draft contains harmful provisions that will be detrimental to people’s health, by creating dangerous provisions that create liability protection for pesticide manufacturers. This threatens Americans with increased exposure to toxicants without liability for the manufacturers, while simultaneously impeding scientific updates, impacting water quality, and eroding states’ rights. The bill markup process started Tuesday March 3rd in the Agriculture Committee and will go through Thursday March 5th. Take action now and ask the members to support Amendment 51 which removes Sections 10205, 10206, & 10207.
Amendment 51 strikes pesticide immunity. (Section 10205)
Amendment 51 strikes the section that strips states of their right to regulate pesticides within their own states and localities. (Section 10206)
Amendment 51 strikes (Section 10207) which allows pesticides to override protections for clean water. Impacting state water quality and health.

WHAT WE KNOW
Markup began the first week in March.
Due to controversy and lack of agreement on language, it is unclear what will happen
The Majority Leader or Chairman ultimately determines how and when it moves.
Constituents pressure matters. Americans must voice their concerns.
Hearings and markups are public and can be attended in person.
The House Agriculture (AG) Committee began it’s formal markup and negotiations on the 2026 Farm Bill this week. The previous time period at the end of February was delayed due to poor weather. This week the language is debated, amended, and voted in the committee.
Sections 10204–10207 of the Farm Bill are still a dangerous issue by creating what amounts to a de facto liability shield for pesticide manufacturers by amending FIFRA and blocking failure-to-warn claims tied to EPA-approved labels. Take action here.
If this language advances, it could:
Block Americans harmed by pesticide exposure from seeking justice
Strip states and local governments of regulatory authority
Preempt courts from holding chemical companies accountable
Silence past, present, and future cancer-related claims
Impact the quality of our water
WHY THIS IS IMPORTANT
Those in the health freedom movement have seen firsthand what happened in the 1980s when pharmaceutical companies were granted liability protection for their products. At the time, they were facing mounting lawsuits and sought relief from legal accountability. Congress passed a law that gave them a liability shield. The consequences for our children have been profound, and accountability has been virtually nonexistent. Sound familiar? Now we are seeing the same situation unfold with chemical companies. They are facing an onslaught of lawsuits and, instead of accepting accountability, they are seeking a liability shield—spending over $100 million in lobbying efforts to secure it. The troubling reality is that members of Congress supporting this measure are walking back their MAHA commitments.
Pesticide immunity is not MAHA.
Removing food dyes while protecting toxic chemical exposure is not MAHA.
Shielding companies from liability while 160,000+ active lawsuits allege cancer and harm is not MAHA.
Excluding failure-to-warn claims, especially related to cancer, is not MAHA.
If this language passes, states lose authority, courts lose authority, and families lose recourse. Accountability disappears.

You know the drill. We’ve fought and won huge battles on issues like this in California. The Farm Bill will impact regulations in California as well as across the nation. The next few weeks matter. This is not settled. This is fluid. This is winnable. But only if constituents speak now.
