Pesticide Liability Shield- Urgent Call To Action

PERK URGENT ACTION ALERT
STOP THE PESTICIDE LIABILITY SHIELD IN THE 2026 FARM BILL

DATE: February 19, 2026

CRITICAL DEADLINE: February 23, 2026 (Beginning of AG Committee Markup)

The House Agriculture (AG) Committee is preparing to begin formal markup and negotiations on the 2026 Farm Bill on or around February 23rd. This is when language is debated, amended, and voted out of committee.

Sections 10204–10207 of the Farm Bill create what amounts to a de facto liability shield for pesticide manufacturers by amending FIFRA and blocking failure-to-warn claims tied to EPA-approved labels. Take action here.

If this language advances, it could:

  • Block Americans harmed by pesticide exposure from seeking justice

  • Strip states and local governments of regulatory authority

  • Preempt courts from holding chemical companies accountable

  • Silence past, present, and future cancer-related claims

As outlined in PERK’s formal letter to the Committee, this language grants blanket immunity under the guise of regulatory clarity. It is not reform. It is protection for corporations at the expense of families.

PERK + MOMS ACROSS AMERICA: UNITED FOR ACCOUNTABILITY

PERK has officially teamed up with Moms Across America, led by founder Zen Honeycutt, to oppose this dangerous liability shield.

Moms Across America has conducted independent testing of school lunches and military food, raising serious concerns about pesticide contamination and chemical exposure in the American food supply. Their findings have amplified what so many families are already experiencing — rising chronic illness and growing concern about cumulative toxic burden.

Zen Honeycutt has published critical analysis outlining the serious consequences of shielding pesticide manufacturers from accountability. We encourage you to review their reporting and research here: https://www.momsacrossamerica.com/blog

WHAT WE KNOW

  • Markup begins February 23.

  • Due to controversy and lack of agreement on language, it is unclear what will happen

  • The Majority Leader or Chairman ultimately determines how and when it moves.

  • Constituents pressure matters. Americans must voice their concerns.

  • Hearings and markups are public and can be attended in person.

WHY THIS IS IMPORTANT

Those in the health freedom movement have seen firsthand what happened in the 1980s when pharmaceutical companies were granted liability protection for their products. At the time, they were facing mounting lawsuits and sought relief from legal accountability. Congress passed a law that gave them a liability shield. The consequences for our children have been profound, and accountability has been virtually nonexistent. Sound familiar? Now we are seeing the same situation unfold with chemical companies. They are facing an onslaught of lawsuits and, instead of accepting accountability, they are seeking a liability shield—spending over $100 million in lobbying efforts to secure it. The troubling reality is that members of Congress supporting this measure are walking back their MAHA commitments.

  • Pesticide immunity is not MAHA.

  • Removing food dyes while protecting toxic chemical exposure is not MAHA.

  • Shielding companies from liability while 160,000+ active lawsuits allege cancer and harm is not MAHA.

  • Excluding failure-to-warn claims — especially related to cancer — is not MAHA.

If this language passes, states lose authority, courts lose authority, and families lose recourse. Accountability disappears.

WHAT YOU NEED TO DO — NOW

1. SEND AN EMAIL TODAY. It will take less than 1 minute to take action.

Take action here. We’ve already pre-drafted a letter for you. It will take less than 1 minute to take action. There are no excuses. We’ve been advised that the action emails should go to the House Agriculture Committee and to Members of Congress. Ask members to strike Sections 10204–10207, preserve state authority under FIFRA, protect the constitutional role of the courts, and reject any pesticide liability shield.

2. CALL THE AG COMMITTEE REPUBLICAN STAFF

Phone: 202-225-2171

Call AG Committee Republican staff and AG Committee members directly. If needed, ask to be transferred to the policy staffer who covers pesticides.

Sample message: “I am calling as a constituent to oppose Sections 10204–10207 of the Farm Bill. Granting immunity to pesticide companies breaks MAHA commitments and removes accountability for cancer-related harm. Please strike this language.”

3. ATTEND THE AG MARKUP HEARING (Around Feb 23) in DC

Markup sessions are public. Members will debate amendments, speak to their markups, and vote in committee. Details will be posted on the House Agriculture Committee website. Being present matters.

4. SHARE THE ACTION ALERT AND LINK

FINAL MESSAGE TO PERK MEMBERS

The next 72 hours matter. This is not settled. This is fluid. This is winnable. But only if constituents speak now.
