Secret Bill Passed AB144 Threatens Medical Freedom — Take Action Now

Dear PERK Members,

We are sounding the alarm on AB144, a bill quietly rushed through the California legislature in secret. This law is a direct attack on medical freedom, parental rights, and due process — and it sets a dangerous precedent that could spread beyond California. What happens here often signals what is to come nationwide.

AB144 began innocently as the “Budget Act of 2025,” introduced on January 8, 2025. But at the very last moment, it was gutted, amended, and passed in a matter of days — on September 12, 2025 — with no public comment, no hearings, and no transparency. It bypassed the democratic process entirely and now sits on Governor Newsom’s desk. He has until October 12th to sign it into law.

We must act quickly and urge the Governor to VETO AB144. This bill:

• Centralizes vaccine authority by giving the California Department of Public Health (CDPH) so much power related to immunizations, bypassing the legislature.

• Adds language about the HPV vaccine related to the school schedule for 8th grade and recommendation of the HPV shot for college students. They added additional language to the mandated notification. The section on the HPV vaccine references Section 120164 (a newly created Health Code Section that gives CDPH the power to modify or supplement existing recommendations).

• Rejects CDC and ACIP standards, freezing recommendations as of January 1, 2025 and disregarding future updates.

• Expands liability protections beginning January 1, 2030, shielding anyone administering state-required vaccines to minors from accountability or liability for injury or harm caused.

• Alters insurance and welfare laws without public input.

This bill strips parents and the public of their voice and hands unchecked power to the unelected body of the California Department of Public Health.

Dear PERK Members,

AB 495 was amended to remove the “non-relative caregiver.” This is a win. However, the bill language still creates dangerous loopholes without ID, background check, court oversight, or parental knowledge. This is unacceptable. California’s children deserve real safeguards, not paperwork that can be weaponized. AB 495, Assembly Member Celeste Rodriguez bill is unnecessary.  Education Code 234.7 already allows parents to consent to and authorize a long list of authorized emergency contacts in the event of an emergency.

AB 495 Current Status:

• AB495 passes the Senate.

• Next Stop: The Governor’s desk.

What AB 495 Would Allow

• “Name a child.” A person can identify a child on a school-site form and assume custody/authorized caregiver status with no ID, no verification, no background check, no notarization, and no court.

• Medical authority by checkbox. The form lets a person check one box—“I cannot get a hold of the parent”—and take over medical decisions.

• No parental consent or notice. Parents may not be contacted before decisions are made.

• Records sealed. Confidentiality provisions can seal records, preventing parents and the public from seeing what happened until it’s too late.

• Exploiting legal loopholes. The bill removes critical safeguards that protect children from trafficking, kidnapping, and predation.

• Bottom line: No ID. No verification. No notarization, No parent. No child is safe.

Please veto AB 495. Children deserve stronger safeguards, not weaker ones. Require ID, background checks, parental notice/consent, notarization, and court oversight for any transfer of custody or medical authority. Assembly Member Celeste Rodriguez bill is unnecessary.  Education Code 234.7 already allows parents to consent to and authorize a long list of authorized emergency contacts in the event of an emergency. The safety task force will be looking at all the childhood vaccines, reporting systems, and safety, and will be led by Director Jay Bhattacharya the head of the NIH.

  Director Bhattacharya stated, "By reinstating this Task Force, we are reaffirming our commitment to rigorous science, continuous improvement, and the trust of American families,"

• FDA EUA Revoked – FDA Revokes Emergency Authorization for COVID-19 Vaccines

• CDC Director Fired – Major leadership shakeup at the CDC.

• Paul Offit Fired – Long-time antagonist to medical freedom, Paul Offit, has been fired.

• HHS repealed the policy that incentivized and rewarded hospitals for reporting employee vaccination rates.

• Florida Leads the Way – Surgeon General Dr. Joe Ladapo makes breaking news stating Florida will end ALL vaccine mandates and restore the God-given right to choose what goes in our bodies. • $500 Million in mRNA contracts ended – “We reviewed the science, listened to the experts, and acted,” said HHS Secretary Robert F. Kennedy, Jr. “BARDA is terminating 22 mRNA vaccine development investments because the data show these vaccines fail to protect effectively against upper respiratory infections like COVID and flu.

• President Trump Raises Questions – President Trump openly questions the COVID vaccines and the effectiveness he was sold—or possibly lied to about.

• Dr. Paul Thomas Lawsuit – Dr. Paul Thomas is a plaintiff in a lawsuit against the CDC for failure to test the cumulative effect of the 72-dose childhood vaccine schedule. Watch The Highwire Interview with Dr. Paul Thomas.

• AB 84 – Moves to a 2 year bill due to public pressure. Your action continues to create wins in California. The fight’s not over. It has less of a chance of passing, but the bill can still come back in January. However this gives the unified opposition time to continue the effort to kill it. • AB 495 – Under the public pressure, the bill is amended. The fight is still on.
